Art. 35d

1 Re­new­able thermal and mo­tor fuels may only be put in­to cir­cu­la­tion if they meet cer­tain eco­lo­gic­al re­quire­ments.

2 Re­new­able thermal and mo­tor fuels that are pro­duced from food­stuffs or an­im­al feed or that dir­ectly com­pete with the pro­duc­tion of food­stuffs may not be put in­to cir­cu­la­tion. This does not ap­ply to mass-bal­anced re­new­able thermal and mo­tor fuels that meet the eco­lo­gic­al re­quire­ments.

3 The Fed­er­al Coun­cil shall stip­u­late the eco­lo­gic­al re­quire­ments. In do­ing so, it shall take ac­count of com­par­able in­ter­na­tion­al reg­u­la­tions and stand­ards.

4 It may stip­u­late eco­lo­gic­al re­quire­ments for put­ting in­to cir­cu­la­tion oth­er thermal and mo­tor fuels that gen­er­ate sig­ni­fic­antly lower green­house gas emis­sions than con­ven­tion­al fossil thermal and mo­tor fuels.

5 It may provide that the re­quire­ments un­der this Art­icle do not ap­ply to:

a.
eth­an­ol used for thermal pur­poses;
b.
re­new­able thermal and mo­tor fuels that are only put in­to cir­cu­la­tion in small quant­it­ies.

6 It may provide for fur­ther ex­cep­tions if this is ne­ces­sary due to mar­ket con­di­tions.
