Art. 59

1 The Fed­er­al Of­fice may op­er­ate in­form­a­tion and doc­u­ment­a­tion sys­tems in or­der to carry out pro­ced­ures un­der this Act elec­tron­ic­ally.

2 When pro­ced­ures are car­ried out elec­tron­ic­ally, the au­then­ti­city and in­teg­rity of the trans­mit­ted data must be en­sured.

3 The Fed­er­al Of­fice may grant the fol­low­ing bod­ies and per­sons ac­cess to the in­form­a­tion and doc­u­ment­a­tion sys­tems:

a.
Fed­er­al Of­fice for Cus­toms and Bor­der Se­cur­ity (FO­CBS):
b.
the can­ton­al au­thor­it­ies re­spons­ible for en­force­ment;
c.
per­sons sub­ject to au­thor­isa­tion or no­ti­fic­a­tion re­quire­ments;
d.
the oth­er bod­ies and per­sons des­ig­nated by the Fed­er­al Coun­cil, in­so­far as this is ne­ces­sary for the ful­fil­ment of tasks and du­ties un­der this Act.

4 The bod­ies and per­sons re­ferred to in para­graph 3 may re­trieve per­son­al data from the in­form­a­tion and doc­u­ment­a­tion sys­tems and pro­cess them in­so­far as this is ne­ces­sary for the ful­fil­ment of their tasks and du­ties un­der this Act. The re­triev­al and pro­cessing of par­tic­u­larly sens­it­ive per­son­al data re­lat­ing to ad­min­is­trat­ive and crim­in­al pro­sec­u­tions or sanc­tions is re­served for the bod­ies and per­sons re­ferred to in para­graph 3 let­ters a, b and d.
