on the Surveillance of Post and Telecommunications
(SPTO)

of 15 November 2017 (Status as of 1 June 2022)

Art. 15 Order to conduct surveillance of postal deliveries

The sur­veil­lance or­der sub­mit­ted to the PTSS shall con­tain the fol­low­ing in­form­a­tion:

a.
con­tact de­tails for the or­der­ing au­thor­ity;
b.
con­tact de­tails for the per­sons au­thor­ised to be the re­cip­i­ents of the sur­veil­lance data;
c.
if known, the sur­name, first name, date of birth, ad­dress and oc­cu­pa­tion of the per­son to be placed un­der sur­veil­lance;
d.
ref­er­ence num­bers and case names for the sur­veil­lance activ­it­ies;
e.
the reas­on for sur­veil­lance, in par­tic­u­lar the crim­in­al of­fence to be in­vest­ig­ated by means of sur­veil­lance;
f.
the name of the PSP;
g.
the types of sur­veil­lance ordered;
h.
if ne­ces­sary, ad­di­tion­al in­form­a­tion on a per­son’s postal traffic;
i.
the start and dur­a­tion of sur­veil­lance;
j.
in the case of per­sons bound by pro­fes­sion­al secrecy in ac­cord­ance with Art­icle 271 Crim­PC or Art­icle 70b MCPC: a note on this as­pect;
k.
if need be, the meas­ures to pro­tect per­sons hold­ing pro­fes­sion­al secrets and fur­ther pro­tec­tion meas­ures that the au­thor­it­ies, the PSP and the PTSS must take.
