Art. 52 Providers of derived communication services with more extensive surveillance duties

1 The PTSS shall in a rul­ing de­clare a pro­vider of de­rived com­mu­nic­a­tion ser­vices to have more ex­tens­ive sur­veil­lance du­ties (Art. 27 para. 3 SPTA) if it has met one of the fol­low­ing cri­ter­ia:

a.
sur­veil­lance as­sign­ments for 10 dif­fer­ent sur­veil­lance tar­gets in the past 12 months (ef­fect­ive date: 30 June);
b.
an­nu­al turnover in Switzer­land of CHF 100 mil­lion in two suc­cess­ive fin­an­cial years, provided a large part of its busi­ness op­er­a­tions is provid­ing de­rived com­mu­nic­a­tion ser­vices, and 5000 sub­scribers use the pro­vider’s ser­vices.
