Art. 68a Surveillance Type ML_50_RT: Mobile phone localisation of suspected terrorists in real time 22

1 Sur­veil­lance Type ML_50_RT may be ordered for the mo­bile phone loc­al­isa­tion of sus­pec­ted ter­ror­ists in ac­cord­ance with Art­icle 23q para­graph 3 of the Fed­er­al Act of 21 March 199723 on Meas­ures to Safe­guard In­tern­al Se­cur­ity.

2 It com­prises the com­bin­a­tion of real-time sur­veil­lance of the sec­ond­ary tele­com­mu­nic­a­tions data re­quired for mo­bile phone loc­al­isa­tion in the case of mo­bile net­work ac­cess ser­vices, mo­bile tele­phone and mul­ti­me­dia ser­vices and, if ap­plic­able, con­ver­gent mo­bile ser­vices, in par­tic­u­lar SMS, Voice Mail and RCS.

3 In the case of mo­bile net­work ac­cess ser­vices, the sec­ond­ary tele­com­mu­nic­a­tions data from tele­com­mu­nic­a­tions traffic in ac­cord­ance with Art­icle 54 para­graph 2 let­ters a–c, g and h and para­graph 3 must be trans­mit­ted.

4 In the case of mo­bile tele­phone and mul­ti­me­dia ser­vices and con­ver­gent mo­bile ser­vices, the sec­ond­ary tele­com­mu­nic­a­tions data from tele­com­mu­nic­a­tions traffic in ac­cord­ance with Art­icle 56 para­graph 1 let­ters a, b, d and e num­bers 1 and 9 and para­graph 2 must be trans­mit­ted.
