Art. 18 Obligations of TSPs and PDCSs with more extensive duties to provide information 17

1 The fol­low­ing pro­viders of de­rived com­mu­nic­a­tion ser­vices shall provide the in­form­a­tion via the query in­ter­face of the PTSS pro­cessing sys­tem:

a.
TSPs, with the ex­cep­tion of those with re­duced sur­veil­lance du­ties 51);
b.
PDC­Ss with more ex­tens­ive du­ties to provide in­form­a­tion (Art. 22);
c.
PDC­Ss with more ex­tens­ive sur­veil­lance du­ties (Art. 52).

2 TSPs, with the ex­cep­tion of those with re­duced sur­veil­lance du­ties, shall provide the in­form­a­tion in ac­cord­ance with Art­icles 35–37, 40, 41 and 48b and in ac­cord­ance with Art­icle 27 in con­junc­tion with the Art­icles 35 and 40 auto­mat­ic­ally. They shall provide oth­er stand­ard­ised in­form­a­tion manu­ally or auto­mat­ic­ally if they so re­quest and by ar­range­ment with the PTSS.

3 TSPs with re­duced sur­veil­lance du­ties are not re­quired to provide in­form­a­tion in ac­cord­ance with Art­icle 48b. They shall provide the stand­ard­ised in­form­a­tion as fol­lows:

a.
in writ­ing, out­side the pro­cessing sys­tem by means of a se­cure means of trans­mis­sion au­thor­ised by the FD­JP;
b.
manu­ally, via the query in­ter­face of the pro­cessing sys­tem; or
c.
auto­mat­ic­ally, if they so re­quest and by ar­range­ment with the PTSS.

4 PDC­Ss with more ex­tens­ive du­ties in ac­cord­ance with Art­icle 22 or 52 shall provide the in­form­a­tion in ac­cord­ance with Art­icles 35–37, 40 and 41 and in ac­cord­ance with Art­icle 27 in con­junc­tion with Art­icles 35 and 40 auto­mat­ic­ally. They are not re­quired to provide in­form­a­tion in ac­cord­ance with Art­icles 48a–48c. They shall provide the oth­er stand­ard­ised in­form­a­tion manu­ally or, if they so re­quest and by ar­range­ment with the PTSS, auto­mat­ic­ally.
