Art. 74a Transitional provision to the Amendment of 4 May 2022 relating to the mobile phone localisation of suspected terrorists 133

1 The PTSS shall ad­apt its pro­cessing sys­tem with­in 12 months of the re­place­ment of the real-time sys­tem com­pon­ents of the pro­cessing sys­tems in or­der to be able to con­duct the mo­bile phone loc­al­isa­tion of sus­pec­ted ter­ror­ists in a stand­ard­ised man­ner and re­cord the same in the stat­ist­ics.

2 The TSPs, with the ex­cep­tion of those with re­duced sur­veil­lance du­ties (Art. 51), and PDC­Ss with more ex­tens­ive sur­veil­lance du­ties (Art. 52) shall ad­apt their sys­tems with­in 12 months of the re­place­ment of the real-time sys­tem com­pon­ents of the pro­cessing sys­tems in or­der to be able to con­duct the mo­bile phone loc­al­isa­tion of sus­pec­ted ter­ror­ists (Art. 68a) in a stand­ard­ised man­ner.

3 If the mo­bile phone loc­al­isa­tion of sus­pec­ted ter­ror­ists can­not yet be con­duc­ted in a stand­ard­ised man­ner in ac­cord­ance with Art­icle 68a, pro­viders shall in­stead con­duct the types of sur­veil­lance spe­cified in Art­icle 54 and, if re­quired, Art­icles 56 and 63. The PTSS shall pass on the data in ac­cord­ance with Art­icles 54 and 63 to the au­thor­ised au­thor­it­ies. The PTSS shall only pass on the data in ac­cord­ance with Art­icle 56 to the ex­tent spe­cified in Art­icle 68a. If its pro­cessing sys­tem is un­able to guar­an­tee this fil­ter­ing, it shall not pass on any data. It shall des­troy data that it does not pass on. The fees and com­pens­a­tion are de­term­ined by the type of sur­veil­lance ordered (Art. 54, 56 and 63).
