Art. 42 Right of the CD to file an action

If the Con­fed­er­a­tion, on the basis of the pro­vi­sions set out in this Chapter, provides so­cial as­sist­ance to a per­son who is en­titled to main­ten­ance con­tri­bu­tions in ac­cord­ance with Art­icle 276 or sup­port in ac­cord­ance with Art­icle 328 of the Swiss Civil Code5, the CD is en­titled, in ac­cord­ance with Art­icle 289 para­graph 2 and Art­icle 329 para­graph 3 of the Swiss Civil Code, to as­sert the claims trans­ferred to the Con­fed­er­a­tion from the main­ten­ance debt­or.
