Ordinance
on the Placing on the Market and Handling of Biocidal Products
(Ordinance on Biocidal Products, OBP)

¹ Biocid­al products may only be placed on the mar­ket or used pro­fes­sion­ally or com­mer­cially if they are au­thor­ised by the No­ti­fic­a­tion Au­thor­ity and la­belled in ac­cord­ance with this Or­din­ance.

² For biocid­al products which are im­por­ted for pro­fes­sion­al or com­mer­cial pur­poses, the con­di­tion spe­cified in para­graph 1 must be ful­filled be­fore they are first sup­plied or first used.

³ The fol­low­ing biocid­al products may be placed on the mar­ket or used pro­fes­sion­ally or com­mer­cially without au­thor­isa­tion, provided that they have been de­clared to the No­ti­fic­a­tion Au­thor­ity in ac­cord­ance with Art­icle 13c, 13d or 13f and no opin­ion has been is­sued by the No­ti­fic­a­tion Au­thor­ity with­in the time lim­its spe­cified in Art­icle 19 para­graph 2:

a.

biocid­al products which have been au­thor­ised in an EU or EFTA Mem­ber State un­der the sim­pli­fied pro­ced­ure spe­cified in Art­icle 26 of Reg­u­la­tion (EU) No 528/2012³⁴;

b.

biocid­al products be­long­ing to an au­thor­ised biocid­al product fam­ily;

c.

biocid­al products re­leased for pur­poses of re­search and de­vel­op­ment.

⁴ As re­gards the hand­ling of biocid­al products in ac­cord­ance with para­graph 3 let­ter c, if these products are or con­tain mi­croor­gan­isms, they are sub­ject to the pro­vi­sions of the Con­tain­ment Or­din­ance of 9 May 2012³⁵ (Con­tainO) and of the Re­lease Or­din­ance of 10 Septem­ber 2008³⁶ (RO).

⁵ The pla­cing on the mar­ket of a biocid­al product whose de­vel­op­ment is based on used ge­net­ic re­sources or on tra­di­tion­al know­ledge based there­on, is sub­ject to the pro­vi­sions of the Nagoya Or­din­ance of 11 Decem­ber 2015³⁷ (NagO).³⁸
