on the Placing on the Market and Handling of Biocidal Products
(Ordinance on Biocidal Products, OBP)

¹ In or­der to con­trol an un­fore­seen danger which can­not be con­tained by oth­er means, the No­ti­fic­a­tion Au­thor­ity may, in con­sulta­tion with the as­sess­ment au­thor­it­ies, au­thor­ise cer­tain biocid­al products for lim­ited and con­trolled use in derog­a­tion from the pro­vi­sions of Art­icles 4 and 5 and Sec­tions 2–4 of this Chapter. The fore­go­ing does not ap­ply to biocid­al products that are or con­tain ge­net­ic­ally mod­i­fied mi­cro-or­gan­isms.

² Biocid­al products au­thor­ised un­der para­graph 1 may, in derog­a­tion from the pro­vi­sions of Art­icle 38 para­graph 2 let­ter b, be la­belled solely in the of­fi­cial lan­guage of the place of use or in Eng­lish.

³ With re­gard to biocid­al products con­sist­ing of or con­tain­ing patho­gen­ic mi­croor­gan­isms, the re­quire­ments of the Con­tainO¹⁵⁴ and the RO¹⁵⁵ must ad­di­tion­ally be met for au­thor­isa­tion un­der para­graph 1.
