Art. 774

b. Re­pay­ments and re­in­vest­ment

 

1If the debt­or is not spe­cific­ally au­thor­ised to re­pay either the cred­it­or or the usu­fructu­ary, he or she must pay them jointly or de­pos­it the amount.

2The be­ne­fit re­ceived, such as the re­pay­ment of the prin­cip­al, if un­der the usu­fruct.

3Both cred­it­or and usu­fructu­ary are en­titled to a se­cure, in­terest-bear­ing re­in­vest­ment of the prin­cip­al.
