2. In the case of joint own­er­ship

 

1In the case of joint own­er­ship of a prop­erty, each joint own­er may cre­ate a mort­gage over his or her share.

2In the case of col­lect­ive own­er­ship, the prop­erty may be made sub­ject to a mort­gage only as a whole and in the name of all co-own­ers.
