2. As­sign­ment

 

1The as­sign­ment of a mort­gage cer­ti­fic­ate debt re­quires the de­liv­ery of the doc­u­ment of title to the as­sign­ee.

2If the title is in the names of a per­son, the title must also be en­dorsed and the name of the as­sign­ee giv­en.

Regeste: Art. 143b SchKG und Art. 135 Abs. 1 SchKG, Art. 68 Abs. 1 lit. b VZG, Art. 69 VZG, Art. 110 Abs. 2 VZG und Art. 111 Abs. 1 VZG; Löschung von Pfandrecht und Titel im Falle des Freihandverkaufs. Wird in einer Betreibung auf Pfandverwertung ein Grundstück freihändig verkauft, so gilt - nicht anders als im Falle der öffentlichen Versteigerung - der Grundsatz, dass bei auf dem Grundstück lastenden Schuldbriefen Grundpfandrecht und Titel so weit gelöscht werden müssen, als die persönliche Schuldpflicht nicht überbunden und der Gläubiger aus dem Pfanderlös nicht befriedigt wird.
