V. Processing 1 If a person has processed or reworked an object that does not belong to him, the newly created object becomes the property of that person if the work is more valuable than the material, failing which it belongs to the original owner. 2 Where the person doing such work did not act in good faith, the court may award the newly created object to the original owner even if his or her work is more valuable than the material. 3 Claims for damages and unjust enrichment are reserved. Der Begriff der fremden Sache im Vermögensstrafrecht knüpft an die zivilrechtlichen Eigentumsverhältnisse an (Zusammenfassung und Bestätigung der Rechtsprechung; E. 3.3). Rechtslage bei Betäubungsmitteln, die dem illegalen Verkehr nach einer Polizeiaktion entzogen wurden. Ein derivativer Eigentumserwerb durch den Staat ist von vornherein ausgeschlossen (E. 3.4.1 und 3.4.2). Die Annahme eines originären Erwerbs durch Aneignung scheidet ebenfalls aus, da es an der subjektiven Voraussetzung von Art. 718 ZGB fehlt (E. 3.4.3.-3.4.5). |
