III. Time limits 1 The husband must file the challenge within one year of learning of the birth and of the fact that he is not the father or that another man had sexual intercourse with the mother around the date of the conception, but in any event not later than five years after the birth. 2 The child’s challenge must be filed at the latest within one year of attaining the age of majority.256 3 Once these time limits have expired, a challenge of paternity is admissible provided there is good cause for the delay. 255Inserted by No I 1 of the FA of 25 June 1976, in force since 1 Jan. 1978 (AS 1977 237; BBl 1974 II 1). 256 Amended by No I 2 of the FA of 19 Dec. 2008 (Adult Protection Law, Law of Persons and Law of Children), in force since 1 Jan. 2013 (AS 2011 725; BBl 20067001). |
