4. Renunciation and acceptance of inheritances 1 Without the other’s consent, a spouse is not entitled to renounce an inheritance which would become common property or accept inheritance of an overindebted estate. 2 If the spouse is unable to obtain consent or if it is withheld without good cause, he or she may petition the court.246 246 Amended by Annex 1 No II 3 of the Civil Procedure Code of 19 Dec. 2008, in force since 1 Jan. 2011 (AS 2010 1739; BBl 2006 7221). |
