D. Challenge by the parents 1 If the husband died or lost capacity of judgement before the time limit expired, his father or his mother may challenge his paternity. 2 In this case the provisions governing a challenge by the husband apply mutatis mutandis. 3 The one-year time limit for bringing the claim begins at the earliest on the date on which the father or mother learns of the husband’s death or loss of capacity of judgement. 271Amended by No I 1 of the FA of 25 June 1976, in force since 1 Jan. 1978 (AS 1977 237; BBl 1974 II 1). |
