II. Child of unmarried parents 1 If one parent has parental responsibility, the child takes that parent's surname before marriage. If the parents share parental responsibility, they decide which of their surnames before marriage their children should take. 2 If joint parental responsibility is established after the birth of the first child, either parent may within a year of its establishment declare before the civil registrar that the child should take the other parent's name before marriage. This declaration applies to all common children, regardless of who is given parental responsibility. 3 If neither parent has parental responsibility, the child takes the mother's name before marriage. 4 A change in the allocation of parental responsibility has no effect on names.
