V. Representation 1. In relation to third parties a. Regeste: Art. 273 Abs. 2, Art. 275 Abs. 3, Art. 301 Abs. 1, Art. 307 Abs. 1 und 3, Art. 389 Abs. 2 i.V.m. Art. 440 Abs. 3 ZGB; Weisung an die Mutter, den Sohn mit Blick auf eine allfällige Besuchsrechtsregelung durch die Kinder- und Jugendpsychiatrie "über seinen Vater aufklären zu lassen". Solange der persönliche Verkehr nicht behördlich geregelt ist, entscheidet darüber nicht die Kindesschutzbehörde, sondern die allein sorge- und obhutsberechtigte Mutter (Art. 275 Abs. 3 ZGB). Zur Frage, ob sich die Weisung anstatt auf Art. 273 Abs. 2 ZGB auf Art. 307 Abs. 3 ZGB stützen lässt, insbesondere zum Tatbestand der Gefährdung des Kindeswohls (Art. 307 Abs. 1 ZGB) und zur Verhältnismässigkeit (Art. 389 Abs. 2 i.V.m. Art. 440 Abs. 3 ZGB) des Eingriffs in die privaten elterlichen Erziehungs- und Entscheidungsrechte (Art. 301 Abs. 1 ZGB) im konkreten Fall (E. 3). |
