1The enforcement court shall examine enforceability ex officio. 2It shall allow the unsuccessful party a brief period within which to file its comments. 3On the merits, the unsuccessful party may only argue that matters preventing the enforcement of the decision have occurred since notice thereof was given, such as extinction, deferment, prescription or forfeiture of the right to due performance. Extinction and deferment must be proven by physical records. |
