¹ If the court is in a po­s­i­tion to make a de­cision, it shall close the pro­ceed­ings by de­cid­ing not to con­sider the mer­its or by mak­ing a de­cision on the mer­its.

² The court de­cides by ma­jor­ity.

³ At the re­quest of the suc­cess­ful party, the court shall or­der en­force­ment meas­ures.
