¹ The pro­vi­sions of this Part ap­ply to the pro­ceed­ings be­fore ar­bit­ral tribunals based in Switzer­land, un­less the pro­vi­sions of the Twelfth Chapter of the PILA¹⁸¹ ap­ply.

² The parties may ex­clude the ap­plic­a­tion of this Part by mak­ing a de­clar­a­tion to this ef­fect in the ar­bit­ra­tion agree­ment or a sub­sequent agree­ment, and in­stead agree that the pro­vi­sions of the Twelfth Chapter of the PILA ap­ply. The de­clar­a­tion must be in the form spe­cified in Art­icle 358.¹⁸²
