¹ The ar­bit­ral tribunal de­cides:

a.

ac­cord­ing to the rules of law chosen by the parties; or

b.

based on equity, if the parties have au­thor­ised it to do so.

² In the ab­sence of such choice or au­thor­isa­tion, it shall de­cide ac­cord­ing to the law that an or­din­ary court would ap­ply.
