¹ If the ob­ject in dis­pute is ali­en­ated in the course of the pro­ceed­ings, the ac­quirer may take up the pro­ceed­ings in place of the ali­en­at­ing party.

² The sub­sti­tute party is li­able for the en­tire costs of the pro­ceed­ings. The re­tir­ing party is jointly and sev­er­ally li­able for the costs in­curred un­til the sub­sti­tu­tion.

³ In jus­ti­fied cases, the sub­sti­tut­ing party must, if so re­ques­ted by the op­pos­ing party, provide se­cur­ity to guar­an­tee the en­force­ment of the de­cision.

⁴ In the ab­sence of ali­en­a­tion of the ob­ject in dis­pute, the sub­sti­tu­tion of a party is per­mit­ted only with the con­sent of the op­pos­ing party; spe­cial leg­al pro­vi­sions on the leg­al suc­ces­sion are re­served.
