¹ In the case of an ac­tion and coun­ter­claim, the value in dis­pute is de­term­ined by the ac­tion with the high­er value.

² For the pur­pose of de­term­in­ing the costs, the val­ues of the ac­tion and the coun­ter­claim are ad­ded to­geth­er in­so­far as they are not mu­tu­ally ex­clus­ive.
