¹ An amend­ment of the state­ment of claim is ad­miss­ible if the new or amended claim is sub­ject to the same type of pro­ced­ure and:

a.

a fac­tu­al con­nec­tion ex­ists between the new or amended claim and the ori­gin­al claim; or

b.

if the op­pos­ing party con­sents to the amend­ment of the state­ment of claim.

² If the value of the amended ac­tion ex­ceeds the ma­ter­i­al jur­is­dic­tion of the court, the court shall trans­fer the case to a court with great­er ma­ter­i­al jur­is­dic­tion.

³ A lim­it­a­tion of the ac­tion is per­mit­ted at any time; the seised court re­tains jur­is­dic­tion.
