Art. 82 Procedure
1 The request for the third-party action to be admitted must be made with the answers or the reply in the main proceedings. The notifying party shall set out the prayers to be raised against the third party together with a brief statement of the grounds. They shall not be quantified if they relate to the same contractual performance to which the notified party is obliged in the main proceedings.54 2 The court shall give the opposing party and the third party the opportunity to respond. 3 If the third-party action is admitted, the court shall determine the time and extent of the related exchange of written submissions, subject to Article 125. 4 An objection may be filed against the decision to admit the third-party action. 54 Third sentence inserted by No I of the FA of 17 March 2023 (Improving Practicality and Law Enforcement), in force since 1 Jan. 2025 (AS 2023 491; BBl 2020 2697). |
