on Telecommunications Installations
(FAV)

¹ The fol­low­ing are ex­emp­ted from the pro­vi­sions in Chapter 2:

a.²⁴

ra­dio equip­ment that is in­stalled and op­er­ated ex­clus­ively on fre­quen­cies al­loc­ated to the mil­it­ary for mil­it­ary, civil de­fence or oth­er pur­poses in­volving ex­cep­tion­al situ­ations, un­less it is in­stalled and op­er­ated in a com­mon ra­dio net­work with oth­er bod­ies;

b.

ra­dio equip­ment that is in­stalled and op­er­ated solely for tech­nic­al tests by vir­tue of a ra­diocom­mu­nic­a­tions li­cence gran­ted for that pur­pose;

c.

ra­dio equip­ment that is in­stalled and op­er­ated on fre­quen­cies of over 3000 GHz;

d.

ra­dio equip­ment for ra­dio am­a­teurs that is not made avail­able on the mar­ket;

e.

kits (Art. 2 para. 5) to be as­sembled by ra­dio am­a­teurs, re­gard­less of wheth­er they are made avail­able on the mar­ket or not;

ra­dio equip­ment made avail­able on the mar­ket for ra­dio am­a­teurs which has been mod­i­fied by an au­thor­ised ra­dio am­a­teur for his or her own use in ac­cord­ance with Art­icle 44 para­graph 1 let­ters a and b of the Or­din­ance of 18 Novem­ber 2020²⁶ on Us­ing the Ra­dio Fre­quency Spec­trum (RF­SO);

g.

ra­dio equip­ment in­stalled tem­por­ar­ily and op­er­ated by per­sons with for­eign dom­i­cile or re­gistered of­fice for a peri­od of no more than three months:

1.

when its in­stall­a­tion and op­er­a­tion are au­thor­ised by the State in ques­tion, and

2.

when its power and fre­quen­cies com­ply with the tech­nic­al stand­ards fixed by OF­COM;

ra­dio-tele­phony or ra­dio-nav­ig­a­tion equip­ment which is in­stalled and op­er­ated solely and per­man­ently in manned air­craft for the pur­pose of co­ordin­at­ing air traffic and for the safe nav­ig­a­tion of air­craft and which is re­cog­nised for that pur­pose by the Fed­er­al Of­fice of Civil Avi­ation; the lat­ter shall in­form OF­COM of the re­cog­nised equip­ment;

h^bis.²⁸

ra­dio equip­ment in­stalled in un­manned air­craft , the design of which is cer­ti­fied in ac­cord­ance with Art­icle 56 para­graph 1 of Reg­u­la­tion (EU) 2018/1139²⁹ and which is in­ten­ded to op­er­ate only on fre­quen­cies al­loc­ated by the Ra­dio Reg­u­la­tions of 17 Novem­ber 1995³⁰for pro­tec­ted aero­naut­ic­al use;

i.

cus­tom-built eval­u­ation kits destined for pro­fes­sion­als to be used solely at re­search and de­vel­op­ment fa­cil­it­ies for such pur­poses;

j.

trans­mit­ters for meas­ure­ment or test­ing, either in­ten­ded to de­tect and dia­gnose prob­lems on the put­ting in­to ser­vice, in­stall­a­tion and op­er­a­tion of tele­com­mu­nic­a­tions in­stall­a­tions or to es­tab­lish their char­ac­ter­ist­ics and veri­fy their sat­is­fact­ory op­er­a­tion, and in­stalled and op­er­ated by per­sons spe­cial­ised in tele­com­mu­nic­a­tions;

k.

ra­dio re­ceiv­ers for meas­ure­ment or test­ing, either in­ten­ded to de­tect and dia­gnose prob­lems on the put­ting in­to ser­vice, in­stall­a­tion and op­er­a­tion of tele­com­mu­nic­a­tions in­stall­a­tions or to es­tab­lish their char­ac­ter­ist­ics and veri­fy their sat­is­fact­ory op­er­a­tion.

² Ra­dio equip­ment fall­ing with­in the scope of Chapter 3 of this Or­din­ance is sub­ject to the LVEO³¹ and the OEMC³² in re­la­tion to the re­quire­ments for mak­ing it avail­able on the mar­ket. Art­icles 36–40 of this Or­din­ance are re­served.
