Art. 35 Termination of an indefinite term employment contract

1 Neither party may ter­min­ate an in­def­in­ite term em­ploy­ment con­tract ex­cept in ac­cord­ance with the ap­plic­able pro­vi­sions of Swiss law. Em­ploy­ers and private house­hold em­ploy­ees must, in par­tic­u­lar, abide by the no­tice peri­od pro­vi­sions.

2 Fol­low­ing a tri­al peri­od, either party may ter­min­ate the in­def­in­ite term em­ploy­ment con­tract as of the end of any month by giv­ing one month’s writ­ten no­tice in the first year of em­ploy­ment and giv­ing two months’ writ­ten no­tice from the second year of em­ploy­ment on­wards.

3 Each party must con­tin­ue to re­spect their ob­lig­a­tions un­til the no­tice peri­od has ex­pired. Art­icle 33 para­graph 3 ap­plies by ana­logy.

4 The party giv­ing no­tice must provide their reas­ons for do­ing in writ­ing so if the oth­er party so re­quests.
