Art. 37 Own funds

1 There must be an ap­pro­pri­ate ra­tio between the fund man­age­ment com­pany's own funds and the over­all as­sets of the col­lect­ive in­vest­ment schemes un­der its man­age­ment. The Fed­er­al Coun­cil shall spe­cify this ra­tio.

2 In spe­cial cases, FINMA may ease the re­quire­ments, provided this does not ad­versely af­fect the pro­tect­ive pur­pose of this Act, or it may or­der more strin­gent re­quire­ments.

3 The fund man­age­ment com­pany may not in­vest the pre­scribed level of its own funds in fund units that it has is­sued it­self or lend its own funds to its share­hold­ers or any nat­ur­al or leg­al per­son with whom they have busi­ness or fam­ily ties. The hold­ing of li­quid funds with the cus­todi­an bank shall not con­sti­tute a loan.
